Obviously the lawyer is doing his job and trying to make Gaff look like a Saint who has never done anything before and was frustrated due to dirty tactics implemented by Freo throughout the game. They are just trying to have the penalty reduced as much as possible
Is the defence lawyer dirty job to said his client is the victim
 
I actually do think he was aiming for the chest. Brayshaw was running past his left side after blocking his run, and was crouched with his head down and with forward momentum.

I honestly reckon Gaff was surprised he hit him on the point of the chin.

Not condoning the action, but It would be different if Gaff swung directly at his jaw, aiming for the head.

Doesn’t matter IMO. It’s not a mitigating factor. You’re responsible for the punch once its thrown and that’s the line I expect the tribunal to take.

Not saying this is the case and Gaff should get weeks out of the game, probably until 2019, but Chris Judd once got off from striking Steven Baker after he was close checking him all game.

It can definitely happen.
 
would be interesting to see the full reel of an actual taggers job on of the much better players who get tagged.
they got to a whole 7 incidents with Gaff, I reckon Fyfe has had 7 in the first 5 minutes of some games.

Great. Now can you respect that other people might have a different opinion? The tribunal will weigh it up and either consider it or ignore it - that's their job.

Afl should really crack down on the chest punches like they did with jumper punches.

No, you are with relation to the elements of the offence, but it's a different question when it comes to the penalty.

You cant argue 'no element of intent' because you 'didnt intent to strike him high.' Thats irrelevant to the charge being made out.

You can raise it in mitigation to seek to reduce the penalty.

I reckon no one cares about tagging Fyfe because he can’t kick. Might as well let him get it so he can deliver it straight to the opposition.

You can raise it, its his right to do it but I dont think it’ll have the effect of mitigating the sanction given the outcome. My point is its his record that has more of chance of that rather than him throwing a punch.

So surprised he ran away as fast as possible...to inform the Freo medicos of the permanent damage he caused.

Cameron had a shit record, and got 5 weeks for the identical offence (High, severe, intentional).

If you're correct we should see 4 weeks or less for Gaff.

We'll see more than 5 weeks for Gaff (I guarantee you) because the context of the offence is different.
 
If you cant mitigate the penalty, just email in the guilty plea and take the 5 weeks that Cameron got for the same offence (High, Severe, Intentional).

I’m not saying you can’t mitigate it. I’m saying the basis of his intent to hit him in the chest is not one of those factors that should be considered. He threw a punch with enough force to do what it did. If he got him in the chest/rib area it had the potential to fracture a rib. What then?

he’s better off talking about his clean skin record than that if he wants to try and mitigate it. But even then I think this is one of those ones that he just needs to cop what he gets.
