I know people dont rate Sam Maclure but he has been to a lot of these tribunals and his view is that Gaff's QC went down the wrong path by introducing evidence that Gaff was provoked by being closely tagged/ checked etc.

Maclure thought this could only add weeks to his sentence.

Yes he is. He's acting for the AFL. He is obliged to follow their instructions (as long as they are lawful, and dont conflict with another obligation).



There are very good reasons for Alternative Dispute Resolution, and Tribunals, Mediation, Arbitration and so forth, but I wont go into them now.

Again, he isn't a prosecutor. He is an advocate and I agree, ADR is the way to go.

The tribunal is not a model for that and one no other workplace could get away with. It's a stupid, unrepresentative system that needs to be abolished.

Am I the only one thinking that the suspension was decided before anyone entered the room.

Most decisions kind of are in many cases in my experience.

That said, trials can sway the Judiciary in a different direction.
