The general rule is that for expenses to be deductible, they must have been incurred in the earning of assessable income (this can include future income). Then there are some specific rules around legal fees that probably don't apply in this case.

It would be most interesting for him to try and argue he has been taking legal action to protect or enhance his income earning capacity, given he's been telling everyone that he's doing it as a matter of principle, to save the players from an unjust investigation.

We know that AFL players are unable to claim fines imposed by their club or the tribunal as a tax deduction, which always occurred to me as harsh.

ASADA has told the AFL it will not support a special deal allowing Essendon players accused of doping to take part in NAB Challenge games.

The Australian Sports Anti-Doping Authority is adamant players participating in the pre-season competition should lose their right to backdated bans if later found guilty by an AFL tribunal.
