Actually the 2010 anti doping code said no such thing, the AFL appeals tribunal procedures said that, however CAS is bound by its procedures not the AFL appeals tribunal procedures.

These grounds have been discussed here previously and found to be in error, CAS hearing cases de novo has gone to the Swiss surpeme court previously and they found CAS has the right to hear cases de novo.

Paragraph 114 of the award highlights the reason why CAS has this power, those precedent cases cited all got appealed, all failed.

He might be a decent football man, but suspect his comments are more PR than serious legal comments.

Why so condescending? Considering someone like Chris Kaias has made some of the so called "experts" in the media look like absolute fools on legal matters, there's really no point bashing his credentials.

At some point, a boardroom of executives sat around their long table congratulating themselves over the concept of that car crash. They then approved thousands in production money and went about telling friends and family of what a fantastic new show they were about to create.

Not just one person, but a group of highly paid people signed off on that rubbish.


It's pretty amazing.

Because it dispelled some of the myths that "experts" like Gordon kept on harping about ad infinitum. It also shows a horrible lack of knowledge from these people, and that a few of them are peddling an agenda rather than addressing the crux of the issue.

no, I'm just trying to understand how a person posting on BigFooty can make a totally unrelated person look stupid, and you sure haven't explained it. I'm with Armchair Critic on this one, the metaphorical sucking of Chris's wang on this is embarrassing. I'm sure he's a nice person and everything and he's done some fine work on twitter but ****, that's about where it ends

Seriously go and read the 2010 code and look for ANY reference on what are the grounds for appeals.

Than go and read what was ADDED in 2015, not changed but added...

Why was it added? Because in adding the section to the AFL anti-doping code it only applied to doping matters, rather than changing tribunal rules so all tribunal cases got a free double chance.

Than go read paragraph 114 of the award and learn something.

Than spend a day reading decisions on http://www.swissarbitrationdecisions.com to see how rare it's for CAS to get an award sent back, and even rarer declared void. Oh and while looking for them read the cases with grounds similar to what Gordon mentioned and notice they got knocked back.

There is your homework..

I've already explained to you how. Talking heads in the media, so called experienced lawyers, talk crap like how de novo shouldn't have applied. A law graduate cuts through all this BS and explains it for what it is, not for what someone with an obvious agenda is trying to spin.

My point is that even someone like a recent law graduate seems more reasoned, knowledgeable and logical than a veteran lawyer like Gordon who should know better. Hence why his little FAQ there made them look like incompetent fools. That isn't sucking on his wang, that's just stating facts that anyone with a brain can observe and take in.

So then it goes back to your ridiculously condescending post. The guy you were replying to was a law student/graduate. So what? You're just being a prick for the sake of it.
