Not entirely accurate I’m afraid. The nature of an injury sustained in an assault is highly relevant to determine the seriousness of the offence and consequently the seriousness of the sentence.An injury wouldn’t matter; assault is assault regardless.

Please explain to me what the difference is. If I knocked someone out at my work and it wasn’t work related I would be charged. Same as if I knocked someone out on a night out. But apparently if my work is playing AFL and do it in front of national tv it’s ok.Jesus still trying to equate things that happen on a footy field to things happening out in the general public like they are at all comparable in any way

I was speaking from a criminal perspective and how the court’s approach the question of relative seriousness in determining the penalty for a particular offence. I wasn’t addressing the issue of whether someone would or wouldn’t be charged in the first place as that involves either police discretion or that of a public prosecutor who may have to make the decision whether to proceed with a matter on indictment. There are prosecution policies that dictate how those decisions are made and yes, they do take many factors into account, including the relative seriousness of a particular case. Noah Balta the person, has seriously assaulted someone drunk, at night. He has to complete training on booze. He has a curfew that affects 3 games. His employer pays him whether he plays AFL, VFL or not at all. His employer has a list off 44 people who can replace him. But clearly when pointed out by Balta's lawyer that such curfew would effect his employment why wouldn't the curfew be adjusted to on his day of work he has to be home at a certain time 2hrs after a game and then 8hrs.(like others)I think they could have appealed based on the curfew affecting his work, but Balta chose not to, as they didn't want it drag on for another six weeks.
Wise choice to take his whack and the best choice for the club too.

The media and the government want to make an example out of him.it's hilarious all the media trying to say this will affect our culture, we have a bad culture, culture issues could persist into 2026 because of what we did with Balta etc
this incident happened 4 months ago. he told the club immediately and would've been given a fair whack from the club and told to smarten up. he did his punishment and then when the season eventually started missed 4 games. what else is meant to happen? the club keeps telling Balta he's a dickhead 4 months after the incident and not let him play even when he's allowed to? like what does that gain? that seems like a sure fire way to make our culture worse if anything
