It looked like a swing rather than a punch, but the consequences meant it doesn't really matter. Unless there's some mitigating factor we don't know about, then I'd say 4, worst case scenario 5, best case scenario 3.

I will say, I don't think the intent was there, but it won't matter, because the result was shocking. Looking at it again, 5 is likely, 4 is best case scenario if they take into account record and character at all.
