Are you saying that Leeds didn't sign a statement they wouldn't contest the decision?

Why should the league accept arbitration, when you've already said you wouldn't take things any further? The only reason there doing it now is that it's much quicker/cheaper than the other option that Leeds have forced upon the league, and thats court.

All I hear in this thread is about how everyone else is at fault, and it's all a big conspiracy against Leeds. How about taking some responsibility for your own clubs actions?

brighton have a couple of easy fixtures..so playoffs not quite confirmed..but one win will do it

Current table has leeds 9 points behind second placed Carlisle with 2 games to go, we also have a superior GD.

Obviously if we get all 15, we are automatically promoted, theres been a lot of talk of between 5-8 points being given back meaning we'll be close to that second auto promotion spot
We're 4 points ahead of 7th, so a playoff spot is almost assured. From here its either a playoff or auto spot depending on the outcome of arbitration
If we do win, no doubt carlisle and/or doncaster will both appeal, but seeing as its the same panel that handled the west ham/sheff utd tevez affair and sheff utd got nowhere, so it seems this is the final play on this issue

I still cant see us getting anything, Mahwinney has one of his yes men on the panel and that ____ gets what he wants

Cheers for that, I guess this won't be half as controversial as the Tevez affair, but worth Leeds having a go.

The abitration pannel are now looking at one question and one question only - was the punishment of a 15-point deduction fair and just at the time it was handed out. It is this question and this question only which will determin Leeds' fate.

Leeds, clearly, are saying no. The Football League are saying yes.

The arguments have been (and I'm generalising here to avoid penning an novel) as follows:

Leeds United are saying that the didn't break any Football League rules and, hence, the punishment is unfair. They are arguing that AT THE TIME of their emergence from administration there was no statute on the FL books for coming out of administration. Leeds say that the Football League legislated specifically to deal with their situation in retrospect. Essentially, Leeds argue that you can not flout a law prior to said law being introduced and at the time of their "crime" the law was not in place.

The Football League's argument revolves around the vote of league clubs. They say that the vote wasn't on whether Leeds United should be docked points, but whether a 15 point deduction was fair for ANY club who failed to emerge from administration according to new FL rules. Leeds, they say, would simply be the first to be handed such a punishment.

So: In summary, they are considering a question similar this: If you punched somebody in the face, could you be convicted of assault if assault was yet to be made illegal. Could you make rules to fit a crime in retrospect.

In simple legal-ese (i.e, was the deduction a fair and just punishment at the time of it being handed out) the consensus seems to be no. Early indications suggest that Leeds WILL get their 15 points back, and win promotion to the Championship, with a recommendation that clubs affected (Carlisle, Doncaster, Southend, Nottingham Forest) be awarded "significant" financial compensation from the Football League.

Ken has NOT been offered any points back yet (i.e five points as settlement).

The Damned United is a great book.

Hardly flattering to anyone concerned though. I guess you've heard That Irish Bastard Johnny Giles took yer man to court, it ended up being settled out of court but at the expense of a hefty rewrite of the offending passages.

There's an old saying you make your own luck.

Leeds haven't had anymore bad luck than the next club.

They haven't ever had a Munich Air Disaster or been condemned to conference football by drawing the last game of the season.

Perspective.

All clubs have had some form of bad luck, but Leeds have had more bad luck than many other clubs have. Two major examples I would like to point out, would be losing the league title from a goal that everybody but the linesman believed to be miles offside and also losing a European Cup final, where corruption has been alleged in the past but never proven. In the latter game, the referee was so bad, he was stopped from ever taking charge of another european match again.

Just to clear it up for managers/chairman/any useless pundit who writes for the mirror or news of the world
The deduction is not for going into administration, the rules bought in for the leicester situation were followed, we lost 10 points last season

We wont have "cheated" carlisle or Doncaster, the fact is this is a football league, we've earned the correct amount of points throughout the league season to finish above them

What they see and what reality is are completely different.

I just can't see how running a club poorly is considered bad luck.

FWIW, I read this morning that Sony have bought the rights to "That Damned United", and plan to make a movie based on the book.

Leeds beat Plymouth 0-1 today and are guaranteed a play-off place regardless of the tribunal decision (unless logic prevails and the tribunal puts another 5 point penalty for wasting everyones time and just being generally offensive).

A fantastic achievement by everyone associated with Leeds United F.C. The uncertainty over pre-season, players going without pay, the future of the club in doubt, then the blow of losing 15 points at the beginning of the season would be enough to sink many teams but this group has played with incredible spirit to firstly ensure they would become the first side to avoid relegation after being handed a point deduction. To then reach the playoffs even with the deduction is an phenomenal effort.

Thank you to the entire playing squad, Gary Mac, Steve Staunton, Dennis Wise, Gus Poyet and all the others involved. You've done us proud.

15pts, who gives a f**k, we're super Leeds and we're goin' up!
