Should Umpires be able to bring in the game circumstances to the deliberate rule?

This afternoon we saw a controversial deliberate decision and my question is whether umpires should be allowed to bring the circumstances that the current game is in when applying the deliberate rule.

If the exact same spoil was made during the second quarter in a lopsided game then I guarantee it would not be called deliberate but as today's game was a cliff hanger, it was.

Should it be black and white or should the situation in the game be taken into account?

Sure, why not? They make calls based on all manner of variables, eg:
Much easier to get a free in the backline than the forward line.
If the game is tight at the end, you can do lots of things that were deemed against the rules earlier in the game.
If you're an established player you're far more likely to get a free or leniency than a newbie.
The deliberate rule is quite possibly the most farcically implemented rule in our game.
