I am glad you agree:D The basis of the appeal is that Baker was denied due process and therefore has no case to answer

So by having your green teethy guy in your post you know what you're saying is as silly as it is.

He's answered his case and the penalty was 4 + 3 = 7. Tonight wont change that, your club will whinge about it but thats as far as it will go.

Next week it will be forgotten and the only Saints related threads is how you're probably going to miss the finals and how much of a waste that is given the talent (or perceived talent in some cases) your team possesses.

An interesting question raised by a caller on SEN asking what have happened if Gary Coleman was in the place of Baker and the same incident occurred ?. ie. no vision and Jeff ending up with facial injuries.

Would Farmer have been given a holiday regardless of injuries sustained ?. Would Dana Plato still be alive ?

Not a Baker defence, I just find it a fascinating question/hypothetical given the lack of vision of the incident.

While we are at it - What if Baker was Adrian Anderson, or Kevin Bartlett.

Hawk-in-syd, I do agree with you in relation to how St Kilda have prepared for hearings in the past. Our admin has been caught with their pants down on more than one occassion.

However in this case I don't see how they could have argued anything different.

serious question this time

what happened with that other witness that St Kilda had. Heard him on SEN saying he was waiting in another room but they decided not to use him.

I can think of 3 potential reasons

1. he was purposely held back for appeal so they had a valid new evidence card to play
2.assessment that he might contradict existing testimony from Baker who may have strayed from the agreed story
3.perception that freo had dug enough of a hole with inadequate evidence, ie a star witness who had blocked vision of the incident

will he be there tonight or is the procedural defence the best option
Probably 3 with a bit of 2 thrown in (although I disagree with the agreed story part). Clearly he was there to try and substantiate what Baker had said, but given the testimony that resulted in this being at the tribunal in the first place had been discredited, why take the risk?

I don't believe St Kilda will appeal based on new evidence, unless of course they have footage that shows Farmer contributed to the contact.

Thats right whats done is done so why keep going on about it.

What I am saying is fact not speclation. Steven Baker will not play again this season and possibly not to round 6 next season depeneding what happens in the next couple of weeks.

But isn't that the same as when a player used to say 'he just grazed my shoulder' when giving evidence against a player who nearly knocked their head off? The whole reason they have stopped taking evidence from the player who got whacked is that always end up trying to get the other player off.

I'm not convinced Farmer will be able to save him.
 
The referecen is inadmissable as evidence apprantley becasue you cannot introduce new evidenc eino tthe appeals process. So Jeffrey cant save him anyway by the looks. Bye Bye Baker.

I'll just assume you were trying to type fast and thats why there's a bit of a dogs breakfast going on there.

But surely thats one of the reasons an appeal can be heard - new evidence? Having said that I don't think it would help as what I said before - the other player will always try and get the offending player off.
 
Hang on, dejavu, Farmer tells a fib to the tribunal, "I remember now, I tripped and my face smashed into the ground causing the injuries". baker gets off and sends him a SMS, "Thanks for your help Jeff". Then on the first week of On The Couch next year Mike asks "Jeff did you tell a fib at the tribunal last year to get stevie off. Hu yea. AFL fines poor old Jeff 15K:D

Pretty sure most sane people will think its a given that because Jeff had concussion his version of events probably at best blurry. All he said at the tribunal was that he remembered being still and then being on the ground. Had the tribunal accepted his version baker would most likely have gotten off.

He was called to give evidence. Not volunteered. Im not sure about anyone who has had a head injury but it is at best blurry and often you cant remember what happens clearly around the time of the accident. I still have around 3 months missing from my memory from when I broke my neck. I kind of remember what happened but dont really at the same time. Im sure its the same for Jeff.
