So if there's any defects too bad?

Not exactly, but from experience they make it as difficult as possible to find an appropriate contact within.

The company becomes almost inactive, and you need to trace through the shareholding/directorship to work your way back to the parent company etc.

Contacting the builder directly is another option (they're the ones usually under warranty) but they too can sometimes palm you off to the developer.

Point being, my recommendation to anyone is to ensure the property is correct before settling. "We'll fix it for you afterwards" can sometimes be a very dicey situation.
 
Had a surveyor look at the pictures regarding the air con unit and he came with six reasons as to why it's not feasible to go where the builder has stated (not in the doorway, around the corner). Going to be very interesting to see where it goes from here, but we will definitely be fighting this.

How much will it cost to rectify it?


I bought in April 2009 during the GFC. Builder was supposed to include 2 garage doors both with electric motors which were absent upon final inspection. I threatened to pay the settlement less $1500 but couldn't get that through solicitors so just ended up wearing the extra cost rather than fighting it.
Issue for Cruyffy here is that as an apartment building any works you want to do to the outside have to be approved by council and also the owners corporation as you don't "own" the outside of the building even if its one of your apartment's walls. The cost would also be pretty large as if the condensor isn't going on the balcony he will have to pay for the cost of scaffolding and potentially permit amendments as well, could add up to $10k or more.

The builder is still required to fix things if it's a 'defect' which from the sounds of it the AC condensor location is (Cruyff14 focus on the fact it is blocking the balcony drain in any correspondence as that is more of a 'defect' than taking up space on the balcony. Then once they commit to relocating it you can discuss where it should go.). Off the plan contracts generally include a defects liability period of 3 months from handover within which the vendor is required to instruct the builder to repair defects or they can give you the builder's details and you can contact them directly.
 
Yeah, I mean, we've paid our deposit, but if we can delay settlement (save more money), and get an outcome that is more desirable than the current one, we would have won.

Be interesting to see where it goes from here.

TBH your agent sounds like they are just trying to pass the buck. Are you using a conveyancer? Get them involved as they are your legal representation in property purchases, will know the contract pretty well and no doubt have been through this same scenario before.

Yeah I've watched the first two episodes - it's pretty good but it's sorta half comedy, half drama.

Was surprised by The Crown winning best drama, so have checked out the first three episodes of that. It's good, but doesn't grab me as much as Stranger Things or Westworld did.

That exchange on the last page is the latest correspondence, word for word.

Well, I had a surveyor at my work look at it and as I stated, he could pick apart what the builder said just by looking at pictures alone.

Will be contacting my solicitor Monday work to get him to read through the contract (if he thinks it is worth pursuing, and dependent on costs)

We are probably giving the agents the shits but I don't really care. We've paid a lot of money (in relative terms), and there should not be issues like this arising, particularly seems when they can be fixed.

He is a solicitor who deals with property I think. I know he is very thorough, was referred to him through someone at work.

Ideally, if things aren't solved with our most desired outcome (within reason), I will look to delay settlement if possible until we have what we want (and with a bit more money in our pocket) :D

I might check out The Crown. Im 4 episodes into The OA which is really interesting so far.

I thought Game of Thrones would have done better.

I also thought Jimmy Fallon was a shit play it safe host who schmoozes up to the hollywood stars. He really wants everyone to like him so they go on his show. Gervais was a far better host. Way funnier and he gives zero ****s if any of the hollywood stars like him or not. Nobody is off limits. They should get him back.

Gus is a big part of Breaking Bad and it looks like he'll be the same in Better Call Saul. Great character.

Only about halfway through S02.

Does the story become more conjoined? I feel like it's still rather episodic. Makes it hard to follow the peripheral characters.

I feel it all slowly comes together. They dont rush anything, you slowly get to learn about each peripheral character in due time until everyone feels a part of it.

I just want you to hurry up so we can talk about the ending. The final episode. :D

Cruyff will probably beat me.

I got distracted binging Star Trek as that's the main Sci-Fi franchise I hadn't seen, got through the Original Series and now working through the original movies, then I'll go back to Sopranos.

So looking forward to Cloud Nothings album later this month, one of my favourite bands.
cloud nothing's are fantastic. I'm not Part of Me is a fave of mine.
