Hard to see anything going wrong with this piece of legislation. What the f*** have we become under this government?

A former Victorian supreme court judge says new powers proposed for guards in immigration detention centres would in effect authorise them “to beat asylum seekers to death”.

In extraordinary evidence to a Senate hearing on Thursday, Stephen Charles SC said the migration amendment (maintaining the good order of immigration detention facilities) bill 2015 would substantially expand the powers granted to guards in detention centres in a way that would “inevitably encourage violence by guards against asylum seekers”.

The new powers would allow immigration officers – which may include private contractors – to use “reasonable force against any person” if the officer believes it is necessary to protect the life, health or safety of people in detention or to maintain the good order, peace or security of a detention centre.

Such powers potentially give staff with a low level of training a greater level of immunity than that granted to state and federal police forces.

Charles, who sat on the Victorian court of appeal until 2006, said the standard proposed in the bill would introduce a similar test to those that have been considered in the US, and drew parallels with the recent shooting of Walter Scott by the police officer Michael Slager.

“Time and again police in the United States have been acquitted in circumstances such as these,” Charles said.

“These amendments to the Migration Act will in effect authorise guards to beat asylum seekers to death on the basis they reasonably believe it is necessary … to do so.”

He said the fact there would be “no effective way to take proceedings against the commonwealth” would further encourage guards to use excessive force in detention centres, and described the training requirements proposed in the explanatory memorandum of the bill as a “joke in extremely bad taste”.

The bill will give the commonwealth, private companies and guards immunity from civil and criminal liability unless it could be demonstrated that the use of force was not in good faith.

The president of the Australian Human Rights Commission, Gillian Triggs, said the bar on proceedings would make it “virtually impossible” to bring forward an action, because of the difficulty of demonstrating bad faith in legal proceedings.

“Senior courts have ... explained the very high threshold that you must prove to demonstrate bad faith. It’s very had to show a subjective intent of bad faith of a serving officer acting in the course of their employment,” Triggs said.

She said the language in the bill surrounding the scope of the powers “need to be significantly tightened up.”

Triggs added that if the powers were to be included into the Migration Act then the limits to the exercise of the power should also be clearly spelt out.

Gabrielle Appleby, an associate professor with the Renata Kaldor Centre for International Refugee Law, said “the individuals authorised under this bill are not department officers, they are contractors”.

Appleby raised concerns about the training requirements for guards, which are not expressly set out in the bill and will instead be left up to the minister. The explanatory memorandum suggests the standards will be a certificate II in security operations, which are a base level training requirement for security operations.

“The determination by the minister is not a disallowable instrument. This means it’s not subject to parliamentary scrutiny,” she said.

The Senate inquiry follows reports of unrest at the Wickham Point detention centre in Darwin on Wednesday.

I am very pleased now cambodia can get the skills of the people who fled their homeland and in turn these people can live without fear. Also dont forget cambodia will also enjoy the fruits of multiculturism like all the western countries have thrust on them.

The West Australian understands the Navy supply ship HMAS Choules is currently standing off the Vietnamese coast as part of the operation to hand back a group of almost 50 asylum seekers.

The Vietnamese are believed to have been intercepted by customs and navy vessels at sea earlier this month, north of Australia.

I thought they stopped the boats...

In January, the then newly-appointed Immigration Minister Peter Dutton revealed 15 asylum boats containing 429 asylum boats had been turned back since the Government introduced its Operation Sovereign Borders policy.

Though no details have been given since of turn back or tow back operations, it is believed the Navy and Customs have undertaken several missions to push back boats in recent months.

Last month Indonesian media reported that an orange life boat of the type known to be used by the Navy and Customs to push back asylum seekers had been found abandoned on a beach in Java.

When The West Australian revealed details of tow back operations last year the head of Customs asked the Australian Federal Police to conduct an official investigation into the leaks.

BUT they never made it to Australia, thats the big difference that you always overelook. You can still try, but you ain't going to get in by the backdoor. The liberals have been wonderful in stopping the economic migrants from arriving . You cant say they havent as we all know its fact we have not had a wave after wave of economic migrants arriving by boat. Stop spinning it is not going to work this time.

Yes, monocultural Australia was going just fine until some pommie sailors & convicts turned up in a few wooden boat about 230 years ago.

Your being a tad racist by this statement . No country should be monocultural, their should be blend of every nationality under the sun. . Why should the western world be only entitled to enjoy multiculturasim, heaps of other countries like for example japan , china should be encouraged to accept waves of refugees to mix things up a bit.

I think the point is the boats have not stopped but the navy is stopping them from getting to Australia. It would be nice to be told the truth on all this & the cost. I would have thought economic migrants are the people we would like in Australia, self sufficient. Just my opinion. :)
 
People smuggling is the perfect example of the free market at work, I fail to see why the Libs are so anti it. Maybe if the PS ponied up a few pennies for election campaigns the government might see it differently, s**t, the way they operate they might even start subsidising them like they do the other great free marketeers/corporate donors in this country.

No thanks , come in the proper channels or not at all. Australia is doing the right thing, look at the mess Italy is in with the hordes rocking up on their shores what a complete ******* mess they have on their hands. Also the navy is doing a wonderful job stopping them, and as to the cost, it cant be more than having to pay the lifetime benefits for these economic migrants. I don't get why you cant see this its so plain to see the Government has done a superb job in this area, they said they would stop this rort and they did what they said. It seems you just prefer open borders. Well this is not on, the majority of Australians don't want what your selling.

I see it more from a compassionate side, ( the world turned its back on the Jews in the 2nd world war) & if they are economic migrants why are they going to be on life time benefits. Other than aboriginals most people came to Australia by boat, again just my opinion.

Rescuers from Italy and Malta have seen scores of bodies in Libyan waters, said Maltese military spokesman David Cioffi. Children are among the dead.

They're have been 28 survivors so far, while 23 bodies were recovered in an area 73 miles north of Libya, the Italian Coast Guard Admiral Giovanni Pettorino said.

Survivors said that 700 to 800 people had been on board the boat.
 
Situation will of course continue to escalate until Italian Navy and other EU vessels start turning the boats back.
Turn them back to be slaughtered?

Malta and Italy are alone in this, everyone else shrugged off their responsibilities. Malta will not turn away from such tragedies, but if Europe continues to do so it will end up being judged in the hardest of ways."
