dustin is in deep shit. He will receive a very serious assault charge, and will will probably be found guilty.

It will boil down to whether a reasonable person would beleive that Martin actually intended to harm her, not the victim herself. Considering how aggresive and drunk he was Many wittnesses would have beleived he intended to do it.
If witnesses validate the victims version of events Martin should be in a lot of trouble. Football will be the least of his problems.
 
Sharpen up mate. The issue is that posters in this thread are revelling in the opportunity to have a crack at Richmond and its supporters (just as they have done with Essendon over PEDs, North over Majak, Pies over Shaw/Didak/Swan, etc.) when there are conflicting reports over what has occurred and the matter has been referred to police. Dusty is as entitled to the presumption of innocence as any other member of our society, AFL player or not.

This is idle, self-serving speculation.

No doubt there are those who see the issue as an extension of footy, as a chance to give the Tigers a whack. They are sad clowns, and we shouldn't worry about them too much.

What is a worry is that you fail to recognise that a good many people are genuinely disturbed at the thought of a drunken footballer making serious threats to a woman at a restaurant. Don't let your persecution complex blind you to that fact. Yes, Martin deserves a presumption of innocence in a strict legal sense, but that doesn't mean that people will pretend that nothing has happened in the meantime. There is a sketchy outline of some ugly s***, and people are reasonable to feel sickened by it.

I think Martin is guilty of being a drunk, overally aggressive for sure, though from what I have read I do believe the death threats are a complete fabrication. Stab to death with chop sticks, it's ridiculous.. Lol

The HUN report does have a hint of hyperbole about it, but I see that John Silvester is running with a similar theme at Fairfax. He's not one to speak for the sake of it, and he seems more than slightly disturbed that the AFL tried to take the issue on themselves.

Honestly, I don't know why I read the Richmond board's thread in relation to this (morbid curiosity?), but the comments there stagger me more than anything else. Makes me feel like I've tripped through a time warp and found myself at a Salem burning.

You fool. Swan bashed a cleaner at work - cleaning - not some drunk who attacked him first. The man is now borderline intellectually disabled. Stop making excuses for your player.
Swan did not bash a cleaner didn't touch him Carey's nephew did and he was bashed with a club by security guards. But didnt sue anyone. It was another attempt to get money out of a footballer. Don't quote if you weren't there.

Many women I know frequently use chocolate or ice cream as a coping mechanism after traumatic experiences.

No. Channel 9 reported it after they spoke to the restaurant staff.

On the other hand Channel 7 are running as far away from the staff as possible. I wonder why?

But of course most people will turn a blind eye to this and any other form of logic as it will get in the way of their lynch mob.

The thing about the legal provision for a threat to kill, the apprehension that the threat is real must be reasonable. No Essendon player could have reasonably formed a view that Lethal's Lions actually meant to kill them. Big difference to a case where a belligerent and intoxicated person stands over someone and threatens to put a chopstick into their head, don't you think?

I just read up on it out of curiosity, and Swan did indeed assault a cleaner. His assault was in the midst of a bigger altercation between Swan, his mates, and some security guards and the cleaner. It would be fair enough to classify this as a brawl.

Swan seemingly punched the cleaner as he was trying to get up from the ground, no doubt contributing to the man's facial injuries. Swan was seemingly charged for his stupidity, and he was made criminally liable as well as having to pay civil costs. Not much can be said in Swan's defence, and I'm only thankful that he seems to steer clear from that sort of thing these days.

Having said all that, none of this puts Martin's outburst in any better a light.

So just because someone is shaken means they cease to be functional? Why should any victim (alleged or otherwise) act according to a particular script?

There have been cases where women have been r*ped at parties, but where they've then re-joined in the social gathering. I'm in no way whatsoever comparing Martin's alleged outburst with rape, but I'm trying to make a point that the behaviour of victims of crime doesn't have to fit in with anyone else's idea of how they should act after a traumatic event. Such is the wonderful diversity of humanity.

That's strange. Surely channel 7 would be front and centre in questioning the people who were actually there on the evening?

I can't believe a journalist as respected as Rita Panahi - the only person to have printed the truth in the essendon saga - is not all over this.

I read a news report last night which said that Swan can be seen on CCTV punching the guy as he tried to pick himself up. It does seem that others were just as (or perhaps more) responsible for the victim's injuries, but it also seemed clear enough that he contributed to the violence.

Many women I know would be too traumatized to even think about food just moments after an alleged threat like this. Sure after a few hours they would hit the ice cream, but just minutes later?

Many women I know would also want the police to be involved after an incident like this.
 
Said offence occurred Saturday night, she allegedly received death threats, but never wanted to go to the police, it ends up being handed over to the police five days later by the AFL... Sounds suspicious to me..

I think if Richmond and the AFL and the cops had all acted properly and swiftly they would be lauded for their honesty and integrity.

If it had been a female cop assaulted by a normal member of the public, the guy would have been in a cell faster than you could blink.

But he was intoxicated and obviously intimidated the woman as the video has shown... and was asked to leave the premises...

On just those facts alone i'm surprised there has been no sanction handed to Dustin. Something that tells players, sponsors, supported charitys and fans of the Richmond Football club that these facts about Dustin are unacceptable to the Club.

I.e. Dustin will not play in the nab cup because he was intoxicated, had a dispute with a lady stranger, was asked to leave a licenced Premise and can't remember any of it. For that he will be club imposed suspended from all nab cup games pending the investigation from Police into the incident and all the facts come out at which time we will re-assess the sanctions and consider if they are appropriate or if further penalties are warranted.


Instead... no comment... come back and train and represent our club and what it stands for...


Richmond has sent a bad message to all with no action to this point imo.
 
I am telling you I know for a fact that he did not Balmy even saw the video and knew he did not. Carey was also severely injured police at the time thought it would blow over. It took almost a year to come to court. One day he will hopefully write a book and get to tell his side. He is a placid guy nothing phases him all he did was try and help a mate and lost thousands and his reputation. I get sick of people getting in to him about it when I know the truth. Ask anyone who meets him his a pussycat not a thug. Don't believe all that you read.
