There were two separate lines of discussion.

We voted to uphold 2 of the 3 breaches which is why we voted to dismiss the penalty.

You should check with your committee rep before making assumptions about what goes on in there.

He only mentioned in the context of the team being punished for avoiding the injustice of a non-named player being excluded. Read his response again below, it is not that hard to follow.

Not in my opinion.

If power raid was excluded from S34 because of his omission it would have been an injustice.

And to uphold a punitive ruling for avoiding an injustice is counter intuitive to what the rule is all about.
