From my understanding of what Demetriou stated, the AFL has attempted to try and persuade Channel 9/10 to broadcast the draft. However due to prior programming and budget commitments for November, Channel 9/10 can't do it and indeed, under the terms of the contract, are under no obligation to televise the 2001 draft. The 2002-2006 drafts WILL be televised, as under the terms of the contract.
Therefore as the AFL have a contract with Channel 7 to televise the 2001 season, Channel 7 must be under some moral and legal obligation to televise the draft in the 2001 calendar year. The AFL has made it clear that they would prefer the draft to be televised. Channel 7, probably for the reason that there is nothing in it for them, has elected not to do so.
I don't deny the AFL is probably partly responsible, but it appears to me that the final decision as to whether or not the draft is televised must rest primarily with Channel 7. I'd like to know the exact terms of the contract the AFL had with Channel 7 and whether a clause specifiying that the draft must be televised was spelt out.
In any case, taking court action to ensure Channel 7 honors the terms of its contract probably isn't worthwhile and a waste of resources and manpower, given that the contract is almost finished.
