Yes, I understand that and agree with the ruling in that matter.
Theres one thing "the law" fails to take into account. The home owner/resident had no intent to hurt, injure or kill the offender. It is the offender who initiated the incident whilst the victim was minding his/her own business in their own house. The victim is forced to into a situation to which they didn't intend and have no control over. Imagine if a group of African smashed down you back door right now. What would you do? Fight or flight? If it's flight and they murder your child, what would people think of you?

Nope. Just pointing out the hypocrisy of your website. When you get banned for pointing out that left wing voters are less likely to be home owners and YOU support that decision there is something wrong don't you think?

Don't see how this is cardworthy. It is, effectively true. They don't seem to want to assimilate, they congregate. Their intention appears to be to have the environment around them change, not to evolve within their new surroundings.

As an immigrant myself, what you've said there is 100 percent correct.

The more backwards the country the immigrant comes from, the more your statement rings true.

If people want to know what Crash Davis means by 'congregate' just google map or drive through the suburb of Thomastown, Melbourne, and give me your thoughts on the striking architecture.

Do you know any first generation Muslim or African? Or the adult children?

I've met plenty who do more than assimilate.

In fact, kwikfix posted a while ago about an African who was as bigoted as Aussie as he is.


So I guess, you need to point out how ALL Africans don't seem to want to assimilate. Or you need to define what "effectively true" actually means.
Either way, the card is justified by the old standards of BigFooty.
It's a pity those standards have gone now. As that kind of statement (i.e. yours) is more than acceptable now.

Don't try to detain them for the cops - let them run, then your risk ends.

You've done all the hardwork, you'd got the intruder subdued and the cops have been called, with the intruder still in the house, the cops will get there quickly. Hang onto them until the cops get there.

Or, as you suggest, you can just let them go and they run off. They are humiliated, hurt and angry and possibly off their tree on drugs. At the first intersection, they drag some poor woman out of her car who was just minding her own business and speed off. The police arrive and take off in pursuit. The perp runs a red light and t-bones another car. There could be any number of scenarios that happen after you let them run off. Are you happy to live with the consequences if any?
 
We had a young bloke on ice in our little town who looped out and smashed a large plate glass window with his fist in the main street. (Not one single scratch!).
Anyway, he threatened to do another one so I took him down. He was unbelievably strong and I was losing control until a mate, who is 120kg, came and sat on him until the local copper arrived.
After the incident the local copper asked for a meeting with myself and my mate.
He gave us the biggest spray and said that if that kid had a heart attack etc he would have been forced to charge us with manslaughter, even though we were doing the right thing.
His very, very stern advice was to let the shitbag do his thing until the cops turn up.

If your 120kg mate is sitting on him and the kid is screaming that he can't breathe and your mate doesn't get off him and the kid subsequently suffocates, then there are going to be some questions that need to be asked and answered.

It looks like that was the case. He didn't break in to commit a crime; he was just out of his brain. That said, he got what he deserved. The moment you enter someone's house/castle the gloves are off. The occupant needs to do whatever he needs to do and more to protect his family.

It's quite simple. If someone breaks into your house the terminate the threat with maximum force as quickly as possible.

No telling what their intent is and whether they are armed.

There is no line whilst the threat is present. Once the threat has been removed then "the line" comes into play.
 
I catch someone in my property, they better get out before I can get to them. I don't give two stuffs about any laws either. If they come at me with an intent to do great harm, then I will engage all the resources at my disposal until I render them immobile (at the very least), or I am immobile. There'll be no ringing cops either. If some of these campaigners copped a hiding and were thrown in to the streets, the bullshit would die down quick enough.

Even if the junkie had a cardiac arrest, you just tell the copper to write 'self defense' in his report.
 
To be honest I think the legal argument is moot in the heat of the moment - if an intruder is in your house with your child, nobody is going to stop and consider the legal limitation on how appropriate the response is. You're going to do anything in your power to stop that intruder from harming your loved ones.

If the increase in agitation from being restrained led to a heart attack you might be in trouble. The second scenario you state correctly trouble. Only police can get away with that in the name of restraint (have seen coroner cases clear police where restraint arguably excessive as it was a fluid emergency situation)
