True, but this year is especially bad.

We've had 6(?) tribunals this year and 3 have been overturned. That is a shocking outcome for MRO.

Will anyone have the balls to call out Gil over giving up on a 27,000 people crowd for Thursdays games when he went on a massive sacking spree today? i find it morally repulsive myself
Not to mention his decision to completely excise the aboriginal flag from indigenous round so he doesn't have to pay royalties on every footy jumper he sells.

AFL should be applauded for refusing to pay for something that should be free to access.

The issue is a vexed one and extremely complicated, but a business holding the licensing rights for an artefact of cultural significance such as a flag recognised under legislation as a "flag of national significance" is ****ing vapid and soulless, as you like to say.

Agreed, and the AFL took the direction based on advice from an indigenous advisory group. The backlash if they had used the logo would have been huge.

Sorry but have to disagree. There was no need to remove the flag from Doug Nicholls round. The AFL completely misrepresented this issue in an effort to make maximum profit.

Harold Thomas, the designer and copyright owner the flag has openly said that it is free for anyone (except nazis and racists). They could have had a hundred aboriginal flags surrounding every ground if they wanted to. As reported, the AFL could have flown the flag, painted it on the oval, even had the players wear it on their guernseys. The AFL just weren't allowed to sell those guernseys unless they paid royalties.

Yep and that is the issue.

WAM is collecting royalties for a flag that has cultural and national significance. Arguably, Thomas should never have been provided with the copyright back in the 90's given he created the flag as part of his role in SA government and products created as public servants belong to the government, not the creator.

Vexed issue but I think the AFL made the right call.

I 100% support the free the flag movement. I get that some people might have other views, but that's just me.

Under copyright law, the Federal government is able to compulsorily acquire copyrights of national historical and cultural significance, but that would be extremely controversial for a government to forcefully strip an Aboriginal creator of their property rights against their will (sound familiar?).

Would much prefer some sort of Aboriginal rights trust or similar held the copyright instead of a couple of white entrepreneurs holding businesses like AFL to ransom.

for every other purpose other than clothing - it’s still indigenous owned

And I believe it remains free to use for all non-commercial purposes. The afl only fell foul when they couldn’t commercialise the jumper

they could have painted the circle, they could have flown flags, they could have played with the indigenous flag

they simply couldn’t sell jumpers with it on for profit without paying a royalty

the afl have done well in the PR argument - but the reality is this isn’t as agregious as it first sounded

need to convince the owner to sell it to an aboriginal trust as you say - happy to use taxpayer money for that

but here’s the kicker - if we want to empower indigenous people to make decisions for themselves - we have to accept we may not like the outcomes

The same white folks who bought the license (they own all of them, by the way, as they have a souvenir business also) are the ones who were buying Aboriginal art and replicating them via Indonesian manufacturing and selling them as authentic - to the tune of a $2.3Mn ACCC fine. Then they liquidated the business and started up again and obtained said licenses. So forgive me if I don't trust their ethics or business practices.

Like the indigenous man who owns the barge service to the York Peninsular and uses his influence to block the building of an all weather road.

Life goes on so dont fall of the high horse. We all eek out a living and have our own ethics.

I don’t trust them either

I’m just saying it’s not for us to decide who an indigenous person or corporation deals with

autonomy to control their own destiny means they get to make good and bad decisions like everyone else
 
That's fair. I just hope Harold hasn't been taken advantage of.

I am happy to admit I am an unabashed fan of Ben Wyatt.

I was equally perturbed when i head Rio had destroyed ancient indigenous paintings.

But Bey Wyatt made a good point in the paper - if we are to entrust the indigenous people to govern their future - we have to accept their decisions. That means when a collective group of indigenous leaders ok's a project like that - we may hate it - but it's their call - not ours. I know numerous indigenous people got up in arms - but ultimately it was an indigenous call.

In saying all that - Rio should know better - those things are irreplaceable - i know i went searching for ancient frescos in Turkey - having those in our backyard are priceless.
