When you recontract on Telstra the actual contract termination fee itself is waived, you just have to pay what is owing on the phone. So being say an 11-month old phone, let's estimate there's about $350 to pay out (I have no idea what this is, you have to either go online or instore).
The other X amount is waived (this didn't use to be the case). You can recontract to a higher or lower value spend and still only have to pay what is owing on the phone. Of course once you pay off the phone you now own it, so you can sell it and get money to put towards what you had to spend to pay it off. It's all relative.

My best friend works for Telstra in Geelong and she said if I take my phone to them and get it sent away to be fixed three times, the contract will automatically be cancelled with no fee. But that means driving to and from Geelong up to six times, and having to deal with a shitty replacement phone each time.
