As a parent, I often wonder how I would react in situations like this.

To be honest, I have enormous empathy for the Silvagni family. It must be absolutely awful for them. I can only assume they would devastated that their son did something like that, but at the same time devastated that their son is going to go to jail for the prime decade of his life.

I can't even comprehend what they'd be going through.

But read that again and replace 'son' with 'daughter' (though son is just as valid in this example) and replace 'did something like that' with 'was a victim of rape' and 'devastated that their son is going to go to jail for the prime decade of his life' with 'devastated that this may affect her mentally for the rest of her life'.


Our criminal justice system is way too focused on the criminal and not the victim.
 
Herald Scum going very hard. They do not like being denied their 'story'. Talk bouncing around that the victim was offered a lot of cash to go away, sound a bit off to me but its out there.

If true it does not reflect well on Stephen Silvagni since he is the one with the money. I doubt Tom had enough money to offer "a lot of cash to go away"
 
I hope he gets a mimimum of 15 years, ideally 20 years, which means by the time he is out of prison he is less likely to ever have kids of his own. We don't need him spreading his DNA.

Assuming falsifying evidence secures a gaol term -

First offence, not aggravated, no violence, ‘reputable family’ - my guess is 5 with a minimum of 3.

In a med sec establishment where he’s unlikely to suffer the same fate as his victim.

Rape is always violent in nature, even without hitting or a threat to kill.

Yep.Can't understand why some are having ago at the Silvagni family with the exception being Tom.

Because they've tried to shield the family name by throwing money at the issue.

And if suggestions of trying to pay off the victim come out as true, well...

Look at the Braun Case.
Samething and it turned out to be the right call.

Yes rape is classified as sexual violence in nature.

The aggravators include actual physical violence committed at the time of the act though, along with use of a weapon, vulnerability of the victim, whether the act was done in front of others, ejaculation into the victim, premeditation, home invasion.

This case ticks a few of these but not all which is what would attract the max sentence.

They would have had discovery from the prosecution ie the victim's statement of events. He maintained he wasn't even there and made up false uber receipts to try and get away from the location.

3 years seems to be around the average for digital rape, which i believe is what the charge is? But convincted on two counts, so that might mean more
yes agree, not up-to-date how the law works with these things but I can see silvagni getting two to four years jail time and out on good behaviour in about 14 months
 
I viewed it as the opposite. When you try to pervert the course of justice like this its just a clear high sentence.
You’d think so, but unfortunately that’s not how these things seem to pan out.

He’ll be viewed as a high chance to rehabilitate etc.

His high priced defence will do everything they can to avoid a lengthy jail term

I can't even comprehend what they'd be going through.

I'd be pretty confident that he's lied to them the entire time and they wouldn't have had any reason to not believe his fake evidence. I doubt they'd have gone through what they did if he owned up to them and told them exactly what he did. You'd have to think the best outcome advised by lawyer would have been to plead guilty to a lesser charge and move on.
