I wonder what happened for McCarthy to go from signing a 3 year contract to wanting out within 12 months!
If he threatens to sit this season out, I can see the AFL "leaning" on GWS to to broker a deal whereby he comes back into the fold this season on the promise of a trade back to Freo next season.

If he refuses to play, then the GWS should sue him for breach of contract and seek hefty pecuniary compensation. The AFL should then ban him from the draft for 3 years. The draft and the salary cap was brought in after 90% of Victoria clubs in the VFL were nearly bankrupt. Collingwood was within 12 hours of having the banks close them up (you can't help bad luck) and we know what happened to Richmond and St.Kilda.

There is a free agent clause now and a restricted free agent clause but these slimy player managers are trying to get more and more. It's bad enough you can lose players, but this should not be allowed to happen. You sign a contract you honour it as does the club, or they pay you out if no longer required. If a club terminated a player citing that they were mislead or duded about their ability and refused to pay out his contract there would hell to pay. If this is allowed to happen then player managers will have another bow with which they can attack clubs.

Last thing the AFL wants is cases like this in court, a player could argue that he is no different to any other employee contract and by not allowing him to quit and move to another club the AFL is restraining his ability to trade. Imagine the can of worms that could open if the court supported those claims.re your example of cap and draft in Rugby League a salary cap was ruled to be OK but a draft forcing players to move to clubs was ruled to be unfair.

That being said I'd love a mid-season draft to facilitate clubs being better placed to survive being hit by multiple injuries to players in the same role.

Except the law doesn't support this, he would be allowed to quit and go play VFL or WAFL, etc. Requesting to shift branches can be rightfully refused, no different from the company I work for requesting I work in east melbourne instead of west, I would have no choice but to comply.

Courts have already ruled that players under contract are not allowed to leave willy nilly. Buckenara tried it on the Hawks and The Supreme Court of Victoria determined that Hawthorn’s refusal to permit Gary Buckenara to return home and play for the West Coast Eagles was a reasonable restraint of trade. This was after Hawthorn took up a 2 year option on a contract he believed they werent going to.

Every case that has gone against a league that involves restraint of trade has been about what happens with uncontracted plkayers. Foschini was about forcibly drafting people from zones against their consent. The NSWRL case was about trading uncontracted players without their consent. (It should be noted that in the NSWRL case, they could have modified their draft to accommodate player consent, instead of disbanding it -the court did not rule drafts themselves as unnecessary restraint.)

Colin Sylvia awarded life membership at Melbourne... You have got to be joking ..
Why? Melbourne like Carlton will have rules which have to be met before you are bestowed a Life Membership. Granted Sylvia underachieved but he played 157 games for the Dee's and kicked 129 goals over 10 seasons. I think he deserves his life membership.

The reality is what Freo put up was an insult. Better to burn one player they can afford to lose than be bent over like the Lions

The reality is that GWS wont even get what Freo offered for him next time.

I was not expecting to hear this only a couple of days after I posted about how poor GWS' decision making was.

GWS will soon become the Brisbane Lions (perhaps overstretching a little but not as far as many may think)

Are the Crows difficult to dislike? If you never travel to AO for a game that is.

Seems that way. They do a lot of good things in their community. Both Adelaide clubs do, really. We could learn a lot from following their lead.

So they only get one pick in the late teens for McCarthy next year rather than 2 . Not sure that is a massive issue for them. The bigger issue is keeping such a large talented list of young players together. Need to make sure that any future trades are on their terms.

Not so sure about that. Their academy players are pretty impressive and frankly Brisbane, GC, Sydney & GWS should be allowed to try and develop these zones without interference from Eddie and the AFL. The AFL needs to focus in its own backyard because the game is going down the toilet in Victoria.
