IIRC there is no criminal statute in relation to Hate Speech. I could be wrong though.

Meaning you can make discriminatory comments, as Foloau has, and suffer no criminal consequense.

However you can be sued if such comments are directly aimed at an individual and discriminate that individual.

The State can't criminally penalise anyone for comments such as Folau's.


Which is why I said (in a roundabout way) we have freedom of speech but there are consequences in regards to comments that go against the social norm.

It all depends on what's in his contract. Given that Folau's made some comments in the past that may have offended, the ARU may well have included some clauses which specifically preclude the type of comment he made on social media.

Whilst that makes some sense, who knows?
