Lets assume Bryce Gibbs says he refuses to play for any other club but Adelaide and Hawks take a risk and pick him up

Can he stay home refuse to go and be picked up the next year in the PSD or something by the Crows....?, Could he refuse to go, be delisted next year re enter the draft then go to the Crows??, anyone know
 
Not sure about the system as it stands, but there is definately an strong opportunity for him (perhaps assisted by the Crows) to take the league to court on restraint of trade. Just hasnt happened yet as no-body has had enough incentive to rock the boat....
 
I'm not 100% sure on this, but being drafted is not a legally binding document. The chosen player does not need to sign a contract, but would thus have to sit out the season, as we have no free agent system, apart from the 1 pick Pre season draft. And honestly what true player would want to sit out a season of AFL footy.

This whole thing has nothing to do with Gibbs personally, its just Adelaide trying to cheat the draft system.

I know for fact howver both Cale and Jarryd Morton are prepared to sit out a AFL year to get to the Eagles..... Interesting to see how that one pans out

Does that mean that the Eagles should prepare for massive fines, and Cale and Morton should prepare for a life outside AFL footy?

AFL would never stand for it.
 
i have wondered about this, I remember some agents were reprimanded for giving players free gifts (signed ricky ponting bats) to help get them to their club, but i don't know how that works because if he was picked by a different club i doubt any player would sit out a whole season of football just because they recieved a signed bat from punter.
 
im pretty sure you sign a contract to enter the draft that says you cant sign a contract with any other club besides the one that drafts you.

you can refuse to play for them, but after entering the draft, you cant play for anyone else.

But that wouldn't stop someone from re-entering the draft and being drafted again to a new club. I'm pretty sure Tom Willday can re-enter the draft despite being drafted by the Hawks and not signing a contract.

Gutsy move for a Carlton supporter to accuse another club of cheating ;)

They aren't trying to cheat, just get some equality into the F/S rule which is a total joke

Noel Morton said in the West last year he wants all his boys playing at West Coast and I assume thats still on the cards, he was also on radio and he was pretty firm on the point cos this was when the Gibbs issue was first raised.

If the WCE think the next 2 Mortons are any good the WCE will select them under the father son if the WCE dont think they any good then in fairness to give the kid a chance at AFL footy his Dad cant stop another club picking them up.

Embers brings this up because the change to the F/S system for West Coast makes them both illeligable when they were previously eligable

Firstly, it wouldn't bring down the draft system. Only a legal challenge would do that. Secondly, just because an individual doesn't sign a contract doesn't mean you can pin it on another club. I suppose you think its the Eagles fault that Tom Willday didn't sign a contract with the Hawks?

The WCE want the players.

The Mortons (by all accounts) want to play for WCE.

Where there is a will there is a way.

The AFL can put in all the artificial balancing mechanisims they want but eventually:

The cream rises to the top.

I mean what are the AFL going to do? Put out a rule saying 'Players with the name Morton are not allowed to play for WC'?
 
You can refuse to go but according to the rules you are out of football for 2 years.

He can just do a Watts and play for 2 years and ask to be traded back to SA, wouldn't be the first player that asked to go home. Might aswell get paid for a couple of development years as a first round pick.
 
back in the day i think several adelaide players did it..
both of the jarmans were drafted,
darren to melbourne and brisbane -never went to either
andrew to to brisbane- never went,
chris mcdermott to brisbane- never went
simon tregenza to footscray- never went
darren mead to essendon- never went
david pittman to essendon- never went
rod jameson to north-never went
although it might have been something to do with being under contract or the talk of the adelaide crows

Then buckley only went for the year on the agreement he'd be traded to a melbourne club, so he didn't have to sit out another year of afl.
Same thing with Primus, only signed a 1 year deal to fitzroy so he could pee off elsewhere, not that it mattered in the end.
And a bunch of port players didn't nominate so port could get them when they arrived.

and brett chalmers got done for didling it when richmond took him and he sat it out trying to get to collingwood
