Personally I am all for defending myself and my friends and if i anticipate that someone is going to hit me then I will hit them first. And personally i think your an idiot if you do any different

FFS. Is this poll serious.

Anyone belaiving that ANY person, regardless ofage should goto jail fr a first offence, minor assault is just being a ********.

I am in no way condoning violence, but as far as assaults go this was nothing. The cabbie got a couple of bruises.

If you are going to throw someone in jail for this, then lock up every person that ever hit anyone out of a fit of jealousy, in a pub ruckus or whatever. Let's overflow the prisons with first time offenders.

If you are going take such a tough stance on violence, then you would have no hesitation in allowing Barry Hall to be charged for his hit on Staker. Or for you Black Flag, Setanta O'Failure's attack on Cloke. If Hurley deserves jail time, then there is alot of AFL players out there who you would agree need to be jailed.
If you want to take such a ridiculous overview of assaults, then you will have no problem with sprotsman going to jail for onfeild hits as well.

Grow up.

No court is going to jail a first time minor assault perpetrator, in almost any civilized country on earth.

Honestly, I do not believe anyone should do time unless it's an absolute indictment on society type crime where they're being out of jail is putting society at huge risk (I'm speaking of rapists, murderers, aggravated burglers, etc, etc.)

Hurley should, however,

A) Get a mandatory fine

B) Get a mandatory amount of community service -- this could/should include spending time working on campaigns against domestic (and non-domestic) violence. He should embrace his past behavior by coming clean and being part of campaigns (television commercials and the like) that discourage it. Coming from someone who was guilty of it, they could make a small documentary about how it has changed his life and the understanding and changes he had to make because of a one-time act. He would come out of it looking very classy. In a similar way to former celebrity drug addicts who can teach society by having the "This is what it did to my life, this is the lessons I learned. Please learn them from me because I dont want others to go through what I did" attitude.

C) Have to go through a mandatory anger management class

After that, I think the guy has repaid his debt to society.


Oh and to Big Blow Hard -- you're wrong on the minor assault thing. I had a friend who I went out with one night to a bar in the United States whose wife of three years was getting sexually harrassed and picked on by another man. My friend stepped in and asked the guy several times to leave his wife alone. He refused each time. Said that she was a sexy piece of meat and he'd have her by the time the night was over. He threw the first punch at my mate, he defended himself and then put the guy on the floor with one blow - didn't knock him out, just knocked him off his feet. Despite CCTV and eye witness reports by people other than my mate's friends (including the bar workers, etc.) my mate got charged with assault because the other guy went to the police. The police arrested him (my mate), charged him with assault and when he went to court got found guilty and sentenced a mandatory 70 months in state incarceration for it. Obviously, he appealed but state laws dictate the minimum mandatory sentencing (meaning if they found him guilty then the state HAD to, it had no choice because of the stupid laws, give him 70 months). It's why when I returned here and heard all the talk of the minimum mandatory sentencing discussion because of that poor guy who tried to help the other guy at the nightclub but ended up getting killed I had to scream NO! Minimum mandatory sentencing does not work.

That sounds friggin harsh. Perghaps when I said civilized country, the USA (or certain states) do no not qualify. :( Hope he continues to fight to clear his name. He wasn't by any chance African-American? they seem to get a raw deal still over there. I am quite perplexed by some of the sentancing over there. Car theft is not a ten year crime IMO, but some of their tough sentancing for murder and rape i fully support.
 
Actually, no, he's a good honest caucasion guy, comes from a really great family, his father is a CEO of a company (in the same state), he was in line for the position after he retired (not a father owned company, mind you) but heres the kicker -- guy played in the NFL. Wasn't a star but did spend three years mostly on the NY Giants practice squad but played half a dozen games in that time.
 
Poor thread Black Flag, let the courts decide what action should be taken.

My intention is not to predetermine his fate, as you say, that is for the courts to decide. This thread merely poses the question that if he is found guilty of assault, what penalty might apply?

Is the analysis of issues such as this not the very purpose of discussion forums?

That be a better question, 'what penalty will Hurley receive?' with a wider variety of answers, considering that doing time is the least likely outcome and would be excessive. But of course you've stuck to true Black Flog form, at least you're consistant.

I thought your issue was more with the legal ramifications?

As I have said previously in this thread he will likely go on the diversion program escaping a conviction (no criminal record).

Wasn't the ban for the whole NAB Cup?

It has nothing to do with the reputation of indian taxi drivers. Stop making this about race because it clearly isnt a racial issue. If someone feels they are in danger they have a right to act. Whether hurley didnt or didnt at this point only he will know. However just because the man is a taxi driver or indian doesnt mean that people shouldnt defend themselves. Ive been in a similar instance to hurley and although i didnt hit the driver I came very close.

I was coming back from a night in the city and the driver (I wont name the race because its not an issue) fell asleep at the wheel almost crashing into a car on the side of the road (came insanely close). I had to push him to wake him up and physically move the steering wheel myself. I then made the driver pull over got out of the car and refused to pay the taxi fare. When this happened the driver came over, was pretty angry and pushed me. Now at that point the driver was being fairly aggressive and I wouldnt have blamed anyone if they had of hit the guy, I was just about to myself, I ended up threatening him and he walked away. However just because he is a driver or if he was indian doesnt mean that I should just wait until he hits me first. There are many stories similar to this where taxi drivers (not specifically seperated by race) get physical in situations where they dont get their taxi fare. Fact is no matter what occupation you are involved in or what race you are if you act aggressively towards someone who has had a lot to drink odds are you will get hit.

There was some speculation of 1 game from some media outlets I believe. But Essendon announced that that was not their official sanction and later released the actual punishment so far. All NAB Cup or NAB challenge matches should we lose tonight. I think some journos trying to get a scoop jumped the gun, as usual. ;)

ah, NAB cup starts tonight? will have to see if there's a stream of that.
