Not sure if there have been many athletes done for taking drugs under the s0 clause but they would be arguing that it has gone through clinical trials and is not performance enhancing so should be sweet. They are ignoring the fact that it has not been approved by a government health authority. Only if other athletes have been banned under similar circumstances would there be legal ramifications. The issue is that to allow this type of use is extremely dangerous as experimentation with concoctions of supposedly safe drugs would be rife. The s0 clause is in place to prevent this exact type of cowboy pharmacy.

Exactly, theres no escaping it. Essendon can argue it wasnt banned at the time of use all they like but the fact is it was never approved for human use therefore under the code its banned!. WADA wouldnt care how big Essendon are or how many fans they have. There fans are hanging to the last thread of hope.

One thing to be cynical and wary of here... is this a Hail Mary distraction? Are they admitting to taking a drug that has no perceived benefit so that ASADA will focus all their attention on that and ignore the fact that there is another drug they are alleged to have been using and it is very much more so a performance enhancing substance.
