Makes you wonder what old Bryan Martyn would think. He made his way from his deathbed to plead for dollars for the club he loved...and now his son wants to fleece them for what he can.

All very ugly and unpleasant.

Martyn joins Carey in suing Roos

Mick Martyn might have recent off-field issues with one member of the Carey family, but he has joined his former skipper and great mate at Arden Street, Wayne Carey, in taking action against the Kangaroos over a long-service claim.

Having confirmed on Monday that Wayne Carey was suing the club for unpaid long-service leave - television reports on Monday night said his lawyers had lodged papers in the County Court claiming more than $135,000 - Kangaroos chief executive Geoff Walsh admitted yesterday that Martyn had also filed a similar claim.

"Yes, there's an action before the courts from Mick, too," said Walsh.

Walsh refused to comment further, although it is clearly an embarrassing situation for the Kangaroos to have two playing legends taking action against their former club.

Carey played 244 games for North Melbourne-the Kangaroos from 1989 to 2002 before leaving the club in disgrace after an affair with Anthony Stevens's wife was revealed. He played with Adelaide last year.


Martyn made his debut with North a year before Carey and played 287 games in 15 seasons. He left the club in unhappy circumstances last year and played his 300th game with Carlton under long-time coach Denis Pagan before retiring.

The claims came as Carey's older brother, ****, faced assault charges for an alleged attack on Martyn in Wagga Wagga on Sunday. He will appear in Wagga court on March 10.

The present players' collective bargaining agreement provides that players with four to seven years' completed service receive one extra week's leave a year and those with eight or more years receive an extra two weeks.

The issue of long-service entitlements for players has created a lot of angst for players, clubs and the AFL in recent times. Three former AFL players won a landmark settlement early in 2002. Former Essendon flanker Darren Bewick and retired Bulldogs Scott Wynd and Steve Kolyniuk were reported to have received sums ranging between $10,000 and $25,000.

Geez, have the Roos done something to upset all of the former players or something? Would have liked to have been a fly on the wall at that Wagga pub the other day? Visions of sitting down planning out the downfall of the Roos come to mind. If they are owed it, they are owed it I guess but surely these guys know that it will hurt the club?
 
Mate if there is such thing as karma ....Kelli Stevens will fall out of a 6th floor window and land on Wayne Carey and his lawyer.

Wow thats a suprise.

I thought ol' Mick bled blue and white ?

Could this start a chain reaction of players hitting clubs for long service despite already being retired ?

Or is this something that North are probably regretting wasn't handled as soon as the players were elidgle for it and kept completely in-house ?

Either way, interesting stuff no doubt.
 
Like many, was extremely surprised when I read this.

Shall be interesting to see if old Mick cops the same amount of sh*t around the boards that Wayne has been for the last few days.

Since when did footballers have a 'long service' condition in their agreements anyway ??

and why are these guys only going for it now?

how come matthew knights hasn't done it, craig bradley, brett ratten, garry hocking etc etc.

looks like mick is one of waynes disciples, gorrllia see gorilla do.

you would think if this was in place then all player would be doing it.

perhaps all other clubs settle this issue when the player retires and just pay them then or come to a happy medium on the amount. Knowing the roos finiancal sitiuation the perhaps they tryed to call two of their greatest servants bluff hoping that over 15 years odd they had made enough out of the club the supposedly "loved".

since being shown the door said he could never go back (think he too that back thou)

owell certantly is interesting and a little worrying, my opinion of carey has never changed though, he's still a ****ing dog
 
If I didn't receive my superannuation from my current employer when I leave I'd be pretty upset and I would probably do something about it. Why is it not right for a footballer to get what everyone else gets? I know that they are paid well but imo they deserve it, and super is a legal requirement that employers must adhere to, this could be the tip of the iceberg.

Just reread the article again, it's long service not super, but if it's in their contract that they should receive it then the clubs should pay

While these long service claims against the kangaroos will hurt the club the fact of the matter is if these players are owed money then its the kangaroos obligation to pay it regardless of their financial situation.It is not the players fault that their clubs are in strife and considering Martyn and Carey were a big part of the kangaroos success in the 90s and gave good service they should be paid out if the money is owed.

you.ll find in most case,s every employee is entilted to long sevice leave pending on the eba agreement with the employer.
i get 13 weeks for every 10yrs of service.
fact of the matter is the players paid highly or not are within their rights to claim long service.

Thats ridiculous.Regardless of whether your well paid or not if its in your contract and agreed on by the club then its their obligation to pay it
 
Long Service leave is a bona fide entitlement to all employees.

Whether it is ethical on behalf of the players is up to them to decide.

There are ways to limit the amount of LSL ie calculate it off the base salary (exlcudes bonuses for performance) but a bloke like Carey would have had the whip hand at negotiation time so it would have been difficult. Nth erred when they paid him out like they did they should not have paid a cent until he agreed to pursue matters like this.

It is pretty bad to see that two players who were major contributors to their clubs most successful era will be ostracised from the club. In time Carey's off-field actions may have been forgiven but to attack a club over dollars when it is in financial trouble will live for ever.

LSL is paid regardless of how much you are paid. Let's take the NAB CEO for example.

Footballers are employees of their respective clubs. They work hard and put their bodies thru a lot of physical punishment over their careers. They play football as their chosen occupation as opposed to working in a factory or office where they would recieve all the standard employment benefits. They also go thru a lot of mental stress if they are playing below standard and are in a very competitive industry where their performance from week to week depends on how long they are employed and how much they are paid.

BTW footballers have employers just like the rest of us. If they're entitled to the money...they deserve every cent.
 
I don't think it's as clear-cut as some think that footballers are employees of the club.
As far as I understand, in the original claim in 2002, the AFL agreed to pay the claims thus leaving the employees claim untested.
Many think they are contractors rather than employees.
