Ease up on me YOTR, I posted my statement while Hookes was still alive and am saddened as everyone is by his passing, I am also feeling for the family of the alleged offender, if there is a crime in that then I am guilty.

I'm not too sure about that, and considering Hinch said it, it's probably not true anyway. It's not as though double jeopardy applies here. They can charge him with assault, murder and/or manslaughter if they want.

He'll probably recieve his justice ( *cough* ) away from the jail and legal systems anyway considering he's out on bail.

I agree. I think Hinch is mistaken. They can charge him with whatever they want. Its up to the court to decide then. Not sure that the Sth Aust. precedent would apply in Victoria. The fact is murder may be hard to prove in the circumstances, but common law assault doesn't seem appropriate. Pack your toothbrush, I say.

Because he was still alive when the charge was laid he would have been charged with assualt immediately, and as the investigation proceeds and more evidence is gathered further assualt type charges could and would be added. Now he is dead, manslaughter charges will be laid. Manslaughter is when a deliberate assualt causes the direct death of another person, even if taht action wasnt meant to cause death. Murder is when there was direct intent and the action to kill somebody.
 
i'm almost resigned myself to the fact that either has already, or is going to pass on within the next 24 hours :(:(

this is one of the worst incidents the cricketing world has ever seen, particularly australian cricket.

and yes, the guy, from my limited law knowledge, he can be charged with manslaugher.

obviousbly he can't yet, as there is no official announcement that David is dead.

The hospital has denied this to other media outlets including 3AW. Sounds like somebody wanted to break a story before anyone else did and decided checking the facts didn't matter. Today Tonight now talking to Barry Jarman and not talking as if he's dead.

5AA checked this report out with 3AW, who are claiming that Hookes' condition has remained unchanged (as per previous media release). Still (slim) hope for someone who was a great character both on & off the field.

3AW broadcaster Derryn Hinch has cited unnamed sources to predict life support systems for his colleague and Victorian cricket coach David Hookes will be turned off within hours.

"I know it will be announced in the next couple hours that David Hookes has died," Hinch reportedly said today.

Hinch reportedly believes the family of David Hookes' has decided to turn off his life-support system.

Hookes and Hinch both work for radio station 3AW.


Sounds to me like he doesnt sound too alive there. His body might be being kept alive but he is all but deceased.
 
This is bloody horrible, absolutely shattering.
A guy who some say missed out on a glorified one day and test career over certain issues and finally over the last 24 months got his career on track doing amazing things for Vic Cricket and making his mark in commentary. His future was just getting so exciting and this shock happens. He was our favourite son, personally I'd watch the bushrangers and as much as I'd like to see go bad it would always be great to see Hookesy doing well.
There was nothing better than watching Hookesy bat! That 100 off 30 odd balls will always be remember in first class cricket.
It is so bloody sad, it was sad enough when he retired as he was so many peoples hero but this shock is so hard to take.
I am not a guy to cry but at work today when I got told it was hard to hold back the tears, the guy was just cruising and he was so good to see everything going well and this **** bouncer has to come and spoil everything. Killing this bouncer aint the answer, make the bastard face Hookesy's family, his friends, the general public. Make him feel so low, ridicule the **** and make him suffer for the next 60 years off his life.
 
Yes,about time this thread was pulled. The original poster should be ashamed of him or her self. This smacks of someone trying to bignote themselves. The official report is that he is "in an induced coma".

3AW announcers have been told to hope for the best but expect the worst. If you hear any ex-teammates talking about him, they almost always speak in past tense as if they're pretty much resigned to him not making it much further than tomorrow. He was dead for 45 minutes, his chances can't be good.

I think there's a reasonable amount of good information in this thread for it to stay, mods should probably change the title tho. Some of the others (such as those that have been locked but left for everyone to see) should be gone
