The problem seems to be the technicality of not getting hit flush up the rear...regardless then it is a the other drivers fault and that's how the law sees it.

If you get hit on the rear left panel I assume, then its not a rear end incident and the other driver is technically not at fault.

The other suggestion I had from someone close in the Insurance industry is to contact the Third Parties Insurance company (you said you had details of the other driver?) and ring that company and argue that its their driver who has the blame, what are they going to do to fix the car...which again depends upon what cover the other driver had.

The xyz was payroll.

To be fair, it’s a shitty situation all round. I’m the finance manager for a company in voluntary administration – before you ask, the business was in the shit before I got there, and I did my duty in advising the director that we had to go down this road – and the administration process puts all sorts of additional regulatory hurdles in place. To make matters worse, because the pays are coming from the administrators bank account, which is a different bank to ours, there is an extra delay in everyone getting paid. It means that last fortnight, people got paid a day later than normal. Which means that everyone basically thought they weren’t getting paid at all. People were literally in tears on the phone to me asking what was happening, and because it is the administrators who physically make the payments in this period instead of me, I didn’t know there was a delay either, and I didn’t know why there was a delay. All I know is I gave the payroll info to them well in advance of when they needed it. I mean, one woman was so broke couldn’t even put fuel in her car. So when people are bugging me to ask when the pays are getting done, there is a good reason for it. And now I feel bad about getting grumpy about it….

I've had an absolute campaigner of a year. You haven't lived until you've had to lay off your friends because the business can't afford to employ them any more.
