Is it a false allegation though? Or one that just can't be prosecuted due to a lack of evidence?

Both the accuser and a key witness have been found to have lied to police

The court heard when he left the witness box a day earlier, a police officer involved in the case followed him outside to make sure he was feeling OK.

During that conversation, Mr Martin confessed he had lied.

“I am sorry. I lied in my police statement. Am I going to get in trouble?” the officer’s notes from the conversation, which were read out in court and Mr Martin agreed were accurate, said.

Under cross-examination by top criminal barrister Hayden Rattray, for Bruhn, Mr Martin then admitted he had little memory of the night and that his police statement was mostly just stating things the complainant had told him.

His bombshell evidence included him admitting the complainant had tried to show him her police statement; and told him she had lied to police even before he gave his police statement.

“(She) told you previously that she lied to the police about the rape allegations?” Mr Rattray asked.

Mr Martin replied: “From my memory, yes’.”

The witness said the complainant wanted him to make a statement that supported hers.

“It wasn’t a direct, ‘you must say this in your statement’, it was, ‘you don’t remember what happened, so here’s what happened’,” he said.

But Mr Martin acknowledged that he now knew parts of it, including how she had told him one of the men had assaulted him outside the club, were “utterly false”.

He told the court he had “no memory of the accused really even being there”.

Dermot Dann, KC, for Bruhn, told the court the case had been “a horrible stain on the criminal justice system”.

“When it came to these allegations ... the complainant admitted she had lied,” he said.
Unless the KC is now lying like the hooker and her neurologically challenged friend, we can assume the former.
 
Case dropped with complainant and leading prosecution witness admitting to lying. We now know the prosecution long held doubts about the medical and factual evidence but it took the leading prosecution witness to admit in court his story was a complete lie and the complainant had put him up to it.
There was a case in NSW where a woman had accused her ex husband of raping her but there was CCTV she hadn’t been aware of which showed her enthusiastic participation in sex.

It turned out she was a doctor with a substance abuse issue and she as worried he would out her.

Despite everyone becoming aware of the CCTV, he spent another month on remand anyway before they withdrew.

The police are sometimes far too slow to do the right thing even where it’s obvious and there’s a very high likelihood there are people in jail who should not be because there was no watershed moment like this witness imploding or the CCTV in the above matter.

Hours into giving evidence in the high-profile rape case against Geelong midfielder Tanner Bruhn, a key prosecution witness dramatically fled court, complaining of a medical episode.

After a night’s rest he returned to the witness box but with a very different story to tell. One that would see the charges against Bruhn and his longtime friend Patrick Sinnott collapse before the prosecutor’s eyes.

Harrison Martin was emotional as he told the court he’d made his whole story up.

He had no memory of the night he claimed his friend had been coerced into a car with the two accused after a chance meeting outside a regional strip club.

He hadn’t been pushed to the ground by one of them when he tried to intervene. And he hadn’t heard her asking for help in a distressed phone call.

Martin told the court he’d spun the story with details fed to him by the complainant, who he says later revealed to him that she had demanded money from Bruhn and Sinnott.

But he was adamant that whatever had happened with the two men had “obviously upset her”.

The case was adjourned that day, with plans to return in November to hear from the complainant. But instead, on Tuesday, the case was back in Geelong Magistrates’ Court for charges against the pair to be sensationally dropped.

Legal teams for Bruhn and Sinnott now say they are assessing their legal options and called on those responsible for the false prosecution to be “held responsible”.

Not that that matters - just pointing out that some seem to be interpreting this situation as the alleged victim admitting that she made the whole thing up. But that doesn't seem to be the case.

We know that she fed information to the witness who admitted to using those lies. Which is at least some form of crime of PCOJ or whatever the legal term is.

So it might still be he-said she-said in terms of the assault, but the "she" is known to have manipulated the situation by feeding lies to her friend.

Sure, false allegations are rare, but they're less rare against famous people. Although famous people seem to commit these crimes more too......

It's why the assumption of innocence has to prevail.

The way the AFL change their mind every 10 seconds, you'd think this will lead to a change. Tanner lost a year of his career for a false allegation because of this AFL policy.
 
What i dont understand is why when the witness was to shaky and the CCTV so obvious the police didnt do more checking and due diligence before deciding to bring the case to court. It's going to cost the taxpayers a lot of money.
 
You are wrong. False allegations are actually vanishingly rare. This is one of those very rare cases.

That said I hope Bruhn recovers from this and gets a satisfactory outcome through the courts and/or the court of public opinion. Paying for sex isn't the best look for a public figure but it's low on the list of terrible indiscretions.


police, courts have zero interest in proving women lied..Their only interest is to prosecute the man. Even when presented with evidence charges are rarely laid

equating zero prosecutions with false allegations are rare is mind numbing 'logic'

That’s because he had surgery on it. You did absolutely nothing and your point is ridiculously stupid.

Disgraceful conduct by Vic Police and OPP here . Some heads need to roll.
Cant be swept under the rug like most of their **** ups.
Whichever manager at the OPP that approved the charge sheet should be absolutely bollocked.
This was a blatant stitch up from the start.
Probably because some dickhead at the OPP wanted to get a "scalp" and make a name for themselves.

Because the police force is ****ing useless.
 
He'd need to go civil like Depp did.
I doubt there would be any funds worthy of going to court again.

If he got his full pay then he might be able to sue for mental distress under personal injury law and perhaps potential earnings but it's all exceedingly difficult and it might be worth his while just closing the book on this.

The AFL could be another candidate to go after for restraint of trade and I am sure Andrew Dillion and the board would not want this to end up being heard so that maybe a way to top up the finances. I wish both of them all the best in finding inner peace to this horrible situation.
