and it would be whether there is sufficient doubt caused by counter evidence. So (and again, no direct knowledge beyond what is posted here) we have this ambulance report which to me (despite what I have been saying) does lead towards the car hitting cyclist rather than cyclist hitting stationary car; and that is documented contemporaneously against the counter story from Mr and Mrs A, which is a statement from a month later, and could be assumed to also be self interested, so my guess is that there would be less weight

though exactly what is the cyclist hoping to get from this trial anyway? medical expenses are covered by TAC aren't they?

they are fishing. i'd love to be in the court when the defence cross examine the ambo on the matter of the speed. now that would be a treat.

their interest is in a payout. ambulance chasers.

“15YO on bike. Struck on L side by car travelling 40 to 60kmh … PT onto bonnet, then onto windscreen which cracked on impact … thrown onto roadway”

An ambulance report isn’t a crash investigation. It’s to have a medical record about injuries and potential complications to the patient which can be handed to medical personnel at the receiving hospital.

For them they’ll just put down a scene to have something to start off with.

“Struck on L side” doesn’t necessarily assign blame to Andrews, it just records where the cyclist was injured.

Then why not state that in the initial report? If they weren’t at fault and were just driving as per the speed limit, why not just say the cyclist should have given way?

Why did he say they were t-boned and were at a complete stop? which contradicts the AV report.
No breatho on the scene either.

the sight of credlin, kroger and kennett looking increasingly angry/agitated/depressed 2 elections running supports this .... kroger was so angry last election night he was about to go the full louise staley and talk about the peninsula conspiracy that led to andrews breaking his back ...... this is equally true of the herald $cum, the oz and sky after dark crowd - locked away in their anti-dan bunkers, wondering why victorians wont listen to them

Here's how much of the bike path you can see from the intersection before you turn into the road.

How the F is a Ford Territory going to accelerate to 40-60kmh turning right onto that road from the main road from stationary start???

There’s no signs or markings visible to vehicles turning that there is a cycleway or they need to give way.

What’s the cyclist’s version? He was legally stationary in the middle of that cross rod on the cycle path and Mrs Andrews flew around the corner and ran over him?

You might think he's dodgy and that's fair enough. But you've found him guilty where the evidence suggests there is nothing to see here. In fact, evidence that Andrews' version of events is more accurate than the "victim" and his ambulance chasers has been put forward in here.

Ambulance reports are "he said, she said" by nature as they are not eyewitness accounts. Paramedics are not in any way qualified to determine what happened. They take accounts from those who were there to determine possible injuries. And the photo put up of the road where the incident happened strongly contradicts this report and the "victim's" version of events in any case.

The breathaliser situation is strange but you'd be drawing a rather long bow to suggest that is somehow anything to do with Dan Andrews' possibly influencing the cops.

It's muckraking mate. And that's all it is. To suggest anybody actually critiquing the situation objectively is cheerleading is beneath you. Surely the aim is to get to the truth rather than pick a side?
