Bruce Lehrmann's second rape trial in Queensland is a similar case featuring a high-profile accused whose identity was originally shielded. If we look at the timeline there, Lehrmann was charged in January 2023, his committal hearing was in July 2024 (after his notorious defamation case had concluded), and his trial hasn't started yet. In fact, a date hasn't even been set. His lawyer has been spending the whole time arguing about a lack of disclosure of evidence by the prosecution. They had a hearing last month about it and they'll have another hearing this month, and there's no guarantee that'll resolve everything so they can proceed to trial.

The point is, these things can drag on for ages. The Geelong player saga might be going on for another year.

For a first mention I think this actually provided some interesting info as opposed to simply finding a date for a contest.

The defence requesting messages as part of disclosure means they believe the police are in possession of such messages and thus have to be disclosed. If the messages were as as blatant as "I lied about the whole thing" then I find it hard to believe vicpol would want to proceed to contest. It could mean there a messages more along the lines of "I'm worried people will think I lied" or "I've been thinking it over and what I said about this part I'm not sure was quite right" which a defence lawyer will love picking apart.

They’re defence lawyers. Grubby as lawyers and barristers are, they are obliged to give the best legal representation they can to their client, irrespective of whether they are guilty or not.

They would be derelict in their duty if they didn’t seek that sort of material.

Hopefully he ends up ok, didn't do anything to wrong himself. Some other teams supporters might be glad about this situation, not me though.

You're the one who is 'fishing' making that bolded comment because you don't know nor do any of us.... just let the court proceedings take place and in time, hopefully justice will prevail whether that be a guilty or non guilty outcome.

I appreciate what other posters are trying to contribute, but we all know the arguments and perspectives, as well as the jokes and prejudices.

Yeah I think understanding how defences operate is important context to have though. Implying message exists by the defence can mean absolutely nothing.

Some people will read "the defence say a message exists stating that the victim was lying" and think it's as black and white as that when the reality could be the message doesn't exist at all, or the message is being deliberately misconstrued by the defence. Anything to create doubt.

I only commented because I thought some people might interpret the article and think "there's evidence it was a lie" which just isn't true at this stage.

so, am I right in concluding from that article that the next step is a committal hearing, scheduled for September, to determine if the matter is then off to Court?
Yeah, pretty much - it's a contested committal so they'll argue about whether there is sufficient evidence to proceed and to get a clearer idea of what the evidence is.

The Magistrate might decide there's insufficient evidence to proceed and dismiss all charges - though I think that's unlikely.

White man bad = must be guilty.
Looks like the evidence is going to come out so how about we judge it on that.
If he is guilty then he will get what he deserves.
If he isn’t then unfortunately he will still be held guilty by most.
Now we needed a better balance with men and women but as a society we can’t keep telling young men they are the problem.
Time for a new approach. How about we actually hit the offenders that are found guilty of crimes on women and others hard and stop giving second, third, tenth chances because “they had a bad childhood”, “they grew up in a war zone”.
The current approach is just disenfranchising a generation instead of actually punishing properly those who deserve it.
Start applying justice and watch the wheel turn.

agreed. i couldn't care less if someone play's for hawthorn's arch enemy. people are very quick to pile on. in contrast, you look at the media coverage of the alleged mushroom killer and it's almost sympathetic in comparison.
