Yeah I think understanding how defences operate is important context to have though. Implying message exists by the defence can mean absolutely nothing.

Some people will read "the defence say a message exists stating that the victim was lying" and think it's as black and white as that when the reality could be the message doesn't exist at all, or the message is being deliberately misconstrued by the defence. Anything to create doubt.

I only commented because I thought some people might interpret the article and think "there's evidence it was a lie" which just isn't true at this stage.
yes no one knows anything at this point, but there's plenty here already giving a definitive verdict.
 
agreed. i couldn't care less if someone play's for hawthorn's arch enemy. people are very quick to pile on. in contrast, you look at the media coverage of the alleged mushroom killer and it's almost sympathetic in comparison.
What are you talking about. You can't compare the media coverage of the two because there is none for the cat player due to a suppression order.

The judge's response to the defense's claims is interesting. I've seen a case before where similar claims were made and the judge just point-blank asked the prosecution if there was any truth to it and when they said there wasn't he issued a very stern warning about what would happen if the claims later proved to be correct.

Dunno if it means anything here or not but from that article it seems the judge wasn't especially concerned about it.

Not sure BigFooty on this footy player and media on the mushroom lady are a fair comparison. And you did say media so I can only assume you meant it.

If you compared BigFooty reactions to both you'd find mushroom lady is copping it pretty bad here.
 
They’re defence lawyers. Grubby as lawyers and barristers are, they are obliged to give the best legal representation they can to their client, irrespective of whether they are guilty or not.

They would be derelict in their duty if they didn’t seek that sort of material.
I don't disagree, was merely explaining their process.
 
I’m inviting the heat by saying this but it’s the media narrative isn’t it…
White man bad = must be guilty.
Looks like the evidence is going to come out so how about we judge it on that.
If he is guilty then he will get what he deserves.
If he isn’t then unfortunately he will still be held guilty by most.
Now we needed a better balance with men and women but as a society we can’t keep telling young men they are the problem.
Time for a new approach. How about we actually hit the offenders that are found guilty of crimes on women and others hard and stop giving second, third, tenth chances because “they had a bad childhood”, “they grew up in a war zone”.
The current approach is just disenfranchising a generation instead of actually punishing properly those who deserve it.
Start applying justice and watch the wheel turn.

I'm sure that would be the club's plan, but I suspect there's laws - or at least the fear of a lawsuit - preventing them from doing so.

Similar to Jack De Belin in the NRL, he was stood down for the best part of three years. When the contract is in place, there's only so much you can do.

The player in question is contracted until next year from memory.

They'll probably just continue to stand him down and delist him then, without the claims (however dubious they may be) of unfair dismissal.

They could pay out the last year of his contract. Then they're off the hook. Probably what they end up doing.
