on the flip side you could argue that not treating Novak in this way is discriminating in his favor because he is a "role model" where the average unvaxxed would be forced into hotel quarantine (if they are allowed in the first place)
although I think that the feds would have been smarted to have let it drop after the court case and cite "judicial independence" rather than use of ministerial discretion. Its not the fight worth having and you could redirect blame to the judges.
